Digital Millennium Copyright Act (DMCA) Notice
Velocity Tech Inc.Velocity Tech Inc., operating PostIdeas, respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement on our Service.
1. Reporting Copyright Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Service, please notify our Copyright Agent as specified below.
1.1 Required Information
Your DMCA notice must include the following information:
- Physical or electronic signature of the copyright owner or person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to permit us to locate the material (such as URL, newsletter title, date, and description)
- Your contact information including your name, address, telephone number, and email address
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
1.2 What We Do Not Process
We do not process DMCA takedown requests for:
- Original insights and summaries we create from publicly available newsletters (these constitute fair use)
- Attributed references that include author name, publication name, and source date
- User-generated content that properly attributes sources and is transformative
1.3 DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing our Copyright Agent with the following information:
- Your physical or electronic signature
- Identification of the content that has been removed or disabled and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Miami-Dade County, Florida if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

3. Process and Timeline
3.1 Upon Receipt of Valid DMCA Notice
- We will acknowledge receipt within 2 business days
- We will review the claim for validity and completeness
- If valid, we will remove or disable access to the allegedly infringing material within 5-7 business days
- We will notify the alleged infringer of the takedown
- We may provide the alleged infringer with a copy of the DMCA notice
3.2 Upon Receipt of Valid Counter-Notification
- We will forward the counter-notification to the original complainant
- If the complainant does not file a court action within 10-14 business days, we may restore the removed content
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
4.1 Three-Strike Policy
- First offense: Warning and removal of infringing content
- Second offense: Temporary suspension and removal of infringing content
- Third offense: Permanent account termination
5. Fair Use and Transformative Content
PostIdeas operates under the principle of fair use. Our Service:

- Extracts insights and creates summaries from publicly available newsletters
- Provides attribution to original authors, publications, and source dates
- Creates transformative content that adds value through curation and organization
- Does not reproduce substantial portions of original works
- Does not substitute for the original newsletter content
5.2 User Obligations
Users must:
- Create original, transformative content using our insights
- Not copy newsletter content verbatim
- Properly attribute sources when publishing content
- Comply with copyright law and fair use principles
6. Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing or was removed or disabled by mistake or misidentification may be subject to liability.
Please carefully consider whether the content you are reporting is actually infringing before submitting a DMCA notice. False claims can result in legal liability.
